Dell Rapids Township will not allow fencing or landscape material to be placed in the Township road right of way by any owners or renters of land.
Any owners or renters who wish to tile across any Dell Rapids Township road must receive permission from 2 Township Supervisors to cross the road. Gravel needs to be replaced per supervisors’ discretion with repairs to the road to the satisfaction of the Township Board of Supervisors. This policy is retroactive to January 1, 2008.

John Jewett reported on development of the elementary writing curriculum and discussed summer technology projects.
Fran Ruesink reported on students advancing to high school, the 8th grade technology assessment, library usage, writing curriculum development, 8th grade math sections for FY2010, and changes in scheduling elective courses.
Steve Helgeland reported that extended school year services will begin on June 2nd and that 152 special needs students were served in 2008-2009.
Superintendent Ludens reported that an application has been submitted for Qualified School Construction Bonds and notification is expected by June 5th. He reported on special education and middle school staffing needs and was authorized to advertise for an Early Childhood/Special Education teacher, special education associates, and the vacant middle school teaching position.
Superintendent Ludens reported on the process for vacating a street and the availability of temporary classrooms. The consensus of the board was to get costs for various options on the lease of a two-classroom building.
Public comment was heard on the design of the proposed elementary school. Board members commented that accurate facts need to be presented to the public. A public input meeting on the proposed elementary school was scheduled for June 22, 2009 at 7:00 p.m.
President Blankenfeld recessed the meeting from 8:05 p.m. to 8:10 p.m.
09-114 Motion by Munk, seconded by Davis, to approve the second reading and adoption of facility use policy KG and KG-R. All voted aye.
09-115 Motion by Blankenfeld, seconded by Davis, to approve the contract with Mid States School Bus, Inc. for 2009-2010 transportation services. All voted aye.
09-116 Motion by Schuch, seconded by Davis, to declare ten school buses, bus radios, and bus video cameras/equipment as surplus for sale at public auction. All voted aye.
Committee reports and board comments were given. Davis reported that Diane Reiff was named First National Bank teacher-of-the-year, and Karla Gruis was named runner-up. 2009 Peer Award recipients were Connie Hansen, Steve Hegge, and Laurie Schultz. Forty staff members were awarded wellness prizes. White board training will be conducted during the summer. Letters to the editor will be submitted with factual information on the proposed elementary school.
09-117 Motion by Schuch, seconded by Davis, to go into executive session at 9:10 p.m. to discuss personnel. All voted aye.
Blankenfeld declared the board out of executive session at 9:20 p.m. and adjourned the meeting.

PLANNING
Phil Kappen, Assistant Planning Director, gave the first reading of a proposed text amendment to the 1990 Revised Zoning Ordinance for Minnehaha County which would add agriculturally related uses in the RC Recreation-Conservation zoning district as a conditional use. MOTION by Hajek, seconded by Barth to authorize the Auditor to publish Notice of Hearing on 6/23/09. 5 ayes.
Mr. Kappen also gave the first reading on a proposed amendment to the On-site Wastewater Treatment Systems Ordinance related to permit fees and system liner standards. MOTION by Hajek, seconded by Kelly to authorize the Auditor to publish Notice of Hearing on 6/16/09. 5 ayes.
HEARING
The Commission held the scheduled public hearing to consider the 2009-2010 renewal applications for malt beverage licenses for establishments within Minnehaha County. The applications were reviewed by representatives of the Sheriff's, Planning, and State's Attorney's offices. Commissioners were informed that Renner Corner had failed a compliance check on 6/9/08. Sheriff Sgt. Jeff Gromer was present to discuss the compliance check. He also reported that a complaint was sent to the SD Department of Revenue regarding an after hours complaint at DJ's Bar. Dean and Sandy Sorum with Renner Corner were present to answer questions. Commissioner Hajek noted that the Renner Corner failed compliance checks 3 times in the past 5 years. Dean Sorum explained the incident and reported that the clerk, who was also a minor, was let go following the incident. MOTION by Hajek, seconded by Twedt to approve the malt beverage renewal applications for 20 establishments listed on the notice of hearing and deny the application for Renner Corner. Commissioner Kelly favored deferring consideration for the Renner Corner and having them provide written information on what changes they will implement to ensure future compliance. Commissioner Pekas noted the impact the loss of the license will have on the Sorums' business. MOTION to amend by Kelly, seconded by Barth to defer action on Renner Corner for 2 weeks to allow a written explanation. 2 ayes, Hajek, Twedt, and Pekas - nay. Amendment fails. AGREEMENT
Ken McFarland, Commission Administrative Officer, presented an agreement with the SD Unified Judicial System for reimbursement of costs associated with the installation of the CourtSmart system as part of the Minnehaha County Courthouse expansion. The UJS has agreed to provide a cost share at an amount not to exceed $18,000 for the work. The actual cost is $17,123. MOTION by Kelly, seconded by Hajek to authorize the Chairman to sign the Contract/Letter of Agreement for Contractual Services between Minnehaha County and the SD UJS. 5 ayes.
LETTER
Ken McFarland, Commission Administrative Officer, read a draft of a victim impact letter for consideration in the sentencing of Kathleen Gourley, who pleaded guilty to embezzling from the Sioux Empire Fair Association. The letter recognizes the Association as the victim, but also the county commission and taxpayers. Commissioner Pekas was not supportive of some of the language used in the letter. He and Commissioner Barth stated that they would be submitting individual letters. Commissioners supported additional language suggested by Commissioner Kelly. The draft letter will be amended and submitted to the judge by July 10th.
OLD BUSINESS
Commissioner Hajek commented on correspondence she received from a party regarding his experience with the line at the Treasurer's office. Commissioners asked that Treasurer Pam Nelson be present before continuing with discussion.
NEW BUSINESS
At the request of Commissioner Twedt, Sue Roust, Auditor, updated the commission on the results of a telecommunications audit performed by Brenda Shald-Hudelson/Expense Reduction Services. While an annual savings of $5,000 was discovered, it was also found that some telephone services were being undercharged. This resulted in an increase of roughly 41% for each of those lines.
OLD BUSINESS
Treasurer Pam Nelson was present to answer questions on an e-mail from a citizen regarding the number of windows open and some comments that were made. Ms. Nelson explained that her office has been short staffed due to vacations, illness, and vacancies. She gave some options that may alleviate the line, which commissioners suggested be brought up during budget hearings. Commissioner Hajek discussed ways to keep more windows open.
MOTION by Barth, seconded by Hajek to adjourn into Executive Session for contract discussion and a legal briefing. 5 ayes. Following the Executive Session, the Commission adjourned until 9:00 a.m. on Tuesday, June 9, 2009.

This action will still comply with State requirements.
Motion by Testerman to reschedule the public hearing to June 15. Seconded by Wiebenga. Motion carried, 7-0.
VII. Old Business
A. East Quarry Dust Maintenance – Bob Hoffman of L.G. Everist responded to an April 27th request by the Council to review progress that Everist has made in reducing dust at the East Quarry. Hoffman circulated photos of irrigation ponds, clay caps, and water cannons used to contain and settle the dust resulting from crushing of the quartzite rock. Hoffman explained that he has been with Everist for 26 years, and the company has made ongoing efforts to improve dust control. Council President Sommerfeld thanked Hoffman for his presentation.
VIII. New Business
A. Approve Garden Club arbor at Dells Overlook – Dee Saviola of the Dell Rapids Garden Club submitted a request to have the City permit the installation of an iron arbor on City greenspace near the Dells Overlook. The arbor will replace a previous arbor lost to a storm several years ago. A photo of the arbor was circulated. The Garden Club maintains that it will pay for the arbor and the cost of installation.
Motion by Woolf to permit the installation on City property. Seconded by Probst. Motion carried, 7-0.
B. Outdoor Event Permit Application, Tom and Mary Espland – The Espland family submitted an application to perform July 18 in the City Park and seeks to have the permit fee waived as a non-profit entity. The Council discussed factors such as granting park access to non-local parties and having fees waived for groups not formally attached to recognized local service organizations. Council President Sommerfeld noted the length of the event and questioned the potential number of spectators.
Motion by Wiebenga to defer the question to the June 15 meeting while more information is obtained. Seconded by Grovenburg. Motion carried, 7-0.
IX. City Administrator Report
• A Homeland Security Stimulus Grant for non-federal fire station construction has a deadline of July 10. The Grant program is said to be extremely competitive and has $210 million available for shovel-ready projects. Dell Rapids has already invested in planning and site selection with SEH Engineering.
• The City’s engineering firm has visited the Pepper Ridge Road drainage easement along Old Highway 77. The City Staff is on schedule to have a report back to the City Council June 15.
• Administrator Martin and Finance Officer Kerzman will meet with the auditing firm this week to review requirements for the 2008 City audit. Martin and Kerzman will also travel to Vermillion to review the practical applications of the INCODE billing and accounting software used in both towns.
• Southeastern Council of Governments is preparing a revised Zoning Ordinance for the City of Dell Rapids, and SECOG planner Toby Brown can make a presentation at a future Council meeting.
• The South Dakota Municipal League is sponsoring an Elected Official workshop in Brandon June 16. Council members have until June 10 to RSVP.
